TERMS & CONDITIONS
1. GENERAL PROVISIONS
KURASCH-JAGDREISEN acts as an intermediary. By signing the travel registration form, you commission us to plan and organize your hunting trip and authorize us to conclude a travel contract with the respective tour operator named therein, to make flight bookings with the airline of your choice if applicable, and to arrange and conclude further contracts with other service providers (hotels, transport companies, etc.).
Based on your travel registration and the tour operator’s confirmation received by us for the trip you have booked, a travel agency contract is concluded between you and KURASCH-JAGDREISEN. The travel confirmation, flight ticket, and visa will be sent to you after full payment of the corresponding services has been received. Upon signing the travel agency contract, the following is agreed between you and KURASCH-JAGDREISEN:
2. PAYMENT TERMS
Upon signing the travel agency contract, the processing fee and 20% of the total hunting trip price are due. The remaining balance, including the required trophy fee(s), is due no later than 8 weeks before the start of the trip. For hunts involving multiple game species, a lump sum may be agreed upon as a deposit.
Some local hunting outfitters have special prepayment conditions. We will inform you of these in writing if applicable. The flight price for a flight arranged by KURASCH-JAGDREISEN is due upon receipt of the flight invoice. If you have not paid the full travel price, you have no right to receive the travel documents or to participate in the trip. In case of an unsuccessful hunt, the full amount of the trophy fee(s) will be refunded immediately upon your return. The basis for this is the hunting and stay protocol signed by you and the outfitter’s representative.
Any additionally taken game will be entered into the hunting and stay protocol and must be paid either on-site or immediately upon return within 8 days.
3. BOOKING AND PROCESSING FEE
Processing fee per hunter (incl. VAT) €150.00.
Processing fee per accompanying person (incl. VAT) €87.00.
4. CANCELLATION BY THE CUSTOMER
If you cancel the valid travel agency contract, the following cancellation fees will apply:
• Up to 60 days before trip departure: 10% of the arrangement cost;
• 60 to 31 days before trip departure: 50% of the arrangement cost;
• Less than 30 days before trip departure: 75% of the arrangement cost plus 50% of the trophy fee or deposit;
• Less than 10 days before trip departure: 95% of the total hunting trip cost (incl. trophy fees or deposit).
The processing fee is non-refundable. All other costs incurred for the valid travel agency contract (e.g., visa, flight, etc.) will be charged in full in case of cancellation.
The cancellation declaration should be made in writing; the date of receipt of the written notice by us is decisive for calculating the cancellation fees.
KURASCH-JAGDREISEN will attempt to keep these unpleasant costs as low as possible in each individual case through negotiations with the respective outfitter. However, it must be considered that hunting trips require long-term preparation, and in the event of such a cancellation, it is almost impossible to find a replacement customer at short notice.
5. CANCELLATION BY THE TOUR OPERATOR
The tour operator may cancel the travel contract before the start of the trip if the execution of the trip is significantly hindered, impaired, or endangered due to extraordinary and unforeseeable circumstances at the time of contract conclusion, such as escalating political tension, war, strike, epidemics, civil unrest, official orders, destruction of camps, natural disasters, significant weather influences, and all events that could negatively impact the guest’s stay. In this case, no costs beyond the already incurred processing fees will be charged, and deposits will be refunded in full.
6. LIABILITY
Within the scope of the travel agency contract concluded with it, KURASCH-JAGDREISEN is liable for proper intermediary activity, careful selection and monitoring of service providers, conscientious planning and preparation of the trip, and correct description of the tour operator’s services based on careful evaluation of experience available at the time of brochure printing.
KURASCH-JAGDREISEN is not liable for the provision of the services it arranges nor for damages, losses, accidents, and other irregularities during the trip.
The liability of the individual service providers remains unaffected. From and to the destination airport of the hunting area, you will be looked after by the hunting tour operator.
The tour operator is obliged to provide the services contractually agreed with KURASCH-JAGDREISEN and described in the brochure concerning the hunting activity and the services directly related to it (transfer, stay in the hunting grounds, guiding, etc.).
The tour operator acts within the framework of local and country-specific conditions (available hotels for overnight stops, accommodations in the hunting area, vehicles for transfer and hunting, etc.).
The outfitter will make every reasonable effort to enable the client to take the game as contractually agreed.
However, no liability is assumed for the desired hunting success or the desired trophy size, and this does not justify complaints, reduction, or refund of travel costs.
Hunting trips are journeys with special risks (expedition character). The outfitter is not liable for consequences arising from the occurrence of these risks if they happen outside its sphere of duty.
To the extent that services of foreign contractors are arranged, the law of the respective hunting country may also apply.
All claims against the tour operator expire 6 months after the end of the trip.
7. HUNTING CONDITIONS
The hunting regulations applicable in the hunting country must be strictly observed by the hunting guest. Violations, particularly negligent handling of firearms or not having a valid annual hunting license, entitle the outfitter to exclude this person from further hunting. In such a case, there is no right to a reduction in the travel price.
Only firearms with a minimum caliber of 7 mm and high bullet weights with a preferably flat trajectory should be used; for capercaillie and black grouse, small rifle calibers or No. 4 shot are recommended. The guide’s task is to bring the hunting guest within range of the game to be taken. However, the hunting guest is responsible for taking the shot! Before the hunt begins, an agreement should be made between the hunting guest and the guide, with the help of the interpreter, on whether the guide should take a follow-up shot after the guest’s first shot and subsequent tracking of the wounded animal.
Game that is wounded (clear signs such as blood, hair, bone fragments, etc.) and not recovered will be charged at 50 percent of the trophy fee.
Distances covered by car, horse, snowmobile, or helicopter to the habitats of the booked game species are integral parts of the hunting activity.
For all hunting arrangements: Once the booked game is taken, the hunt is considered concluded.
8. COMPLAINTS
Any complaints must be reported immediately on-site to the representative of the outfitter, and remediation must be requested. The guest is obliged to do everything reasonably possible to help resolve any service disruption.
If no solution to the problem is possible, the complaint must be noted in the hunting and stay protocol.
9. HUNTING AND STAY PROTOCOL
At the end of each hunting trip/stay, a hunting and stay protocol is prepared, in which the guest confirms all game taken and travel services with their signature.
Upon return, the protocol serves as the basis for the final fee calculation. Should any reason for a complaint arise before the end of the trip, it must be recorded in writing in the hunting and stay protocol or in a separate complaint report. The protocol and any complaint report must be signed by you and the representative of the hunting/tour operator.
The complaint report will be attached as an annex to the protocol. The protocol must explicitly refer to this annex. After signing, all entries in the protocol are binding and may no longer be changed or supplemented. You confirm that the information is correct at the time of signing.
Unfortunately, subsequent complaints submitted after the end of the hunt cannot be considered.
10. PASSPORT, VISA, AND CUSTOMS FORMALITIES
For travel to CIS countries, a passport valid for at least another 6 months and a valid visa are required.
KURASCH-JAGDREISEN will handle the visa procurement for you, as noted in the travel registration. To obtain the visa for the respective hunting country in time, all required documents (visa application, passport, passport photos) must be received by us no later than 30 days before the trip begins. You will receive a visa application form from KURASCH-JAGDREISEN. When applying for a visa to Russia, proof of international health insurance is also required.
When entering most CIS countries, a completed customs declaration must be presented to the customs officers. Valuables brought along (firearms, cameras, radios, etc.) as well as the amount of currency imported must be listed. The stamped declaration must be kept safely by you and presented to the officers upon exit along with a second completed customs declaration.
11. INSURANCE
The travel price does not include travel cancellation insurance. Taking out such insurance is highly recommended, as it can protect you against cancellation costs if you have a valid reason for not taking the booked trip.
Taking out international health and baggage insurance or a corresponding combination policy is also recommended. Application forms for these respective insurances will be sent to you by KURASCH-JAGDREISEN upon request.
A must is the worldwide validity of your hunting liability insurance for hunting trips in the Asian part of Russia.
12. MISCELLANEOUS
The local hunting/tour operators and KURASCH-JAGDREISEN as the travel agent will do their best to organize a pleasant stay and an eventful and successful hunt for you in the hunting area.
The trips offered by KURASCH-JAGDREISEN take place in the wilderness; the hunting areas are subject to many influences such as weather conditions, fires in the territory, food availability for game in the current year, predators that keep game populations at a “natural” level.
Furthermore, there can always be uncertainties, e.g., flight delays, poor road conditions, unfamiliar food, lack of proper toilets, broken-down vehicles, etc.
A hunting trip is not comparable to a regular vacation trip; therefore, deviations from individual described services within reasonable limits may have to be accepted, and a certain lack of the usual Western European comfort must still be tolerated in CIS countries.
One should bring a certain degree of empathy and understanding for the mentality of the hosts on such trips and accept prevailing local customs. With the right attitude, you will feel very comfortable here and experience an unforgettable hunting holiday.
Errors and omissions excepted.
